Terms and Conditions
for Web Hosting Services
| 1. |
Availability and fitness for purpose.
Central Host Office service is provided
on an 'as is, as available' basis. We make no warranties for the service we
provide. We disclaim any warranty or merchantability or fitness for a
particular purpose. This 'no warranty' makes Central Host Office free from
responsibility for damages resulting from delays, nondeliveries,
misdeliveries, or service interruptions caused by Central Host Office's
negligence or client's errors or omissions. |

Service modifications.
Central Host Office reserves the right
to change the service without notice, including but not limited to access
procedures, menu structures, commands, documentation and services offered.
Central Host Office may modify these terms and conditions upon notice
published at our website. Client's use of Central Host Office services
after such notice constitutes client's acceptance of the modifications to
this agreement. |

Termination of Account.
Central Host Office may terminate
client's account without prior notification immediately, or suspend
client's access to the service, upon any breach of this agreement by client,
including but not limited to refusal or failure to pay for services, or by
sold judgment of Central Host Office that client may be performing
activities harmful to Central Host Office, its clients, employees, vendors,
business relationships, or other clients of Central Host Office and the
Internet. A "cleanup" fee of P50,000 will also be charged if an account
is cancelled due to outgoing unsolicited commercial email or "spam." |

Website content management.
Web site construction and management
is the responsibility of the client. Central Host Office is not responsible
for web site management or files lost or damaged by clients. Backup of all
site files is recommended, and should be maintained by the client on a
machine outside of the servers. |
| 5. |
System updates.
Systems are updated in real time, but
may not be immediate. These processing times may be changed without
notice. If a client or Central Host Office support personnel (authorized
by a client) makes any modifications to an account, the client is
responsible to ensure that these updates have occurred. |
| 6. |
Policy violation.
If an account is used unlawfully or is
in violation of the client policy, Central Host Office reserves the right
to terminate the account without notice and without refunds. Files that
violate the client policy are subject to deletion without notice. Clients
violation this Acceptable Use Policy / Subscribtion Agreement will be held
responsible for damages to Central Host Office, including but not limited
to, our systems, servers, connectivity, reputation, business relationships,
service, network, operations, or equipment. Determining what consititutes
a policy violation is at the sole discretion of Central Host Office, and
includes, but is not limited to, the following:

Spam.
Sending unsolicited commercial email,
cross-posting messages to a large number of usenet groups, posting obscene
or threatening messages while using or referring to a Central Host
Office-provided email address or web site URL is prohibited. The use of
Central Host Office servers as a mail drop for responses to activities
described above is also prohibited. Accounts canceled tue to spam will be
billed a "cleanup" fee of P50,000. |
| b. |
System abuse.
Includes, but is not limited to,
excessive use of CPU resources or disk space, offering free email accounts,
installing IRC bots, CGI scripts sharing with domains outside the assigned
server, or other CGI scripts that use a disproportionate amount of system
resources. Central Host Office will determine what constitutes system
abuse. |
| c. |
Software / multimedia distribution.
Accounts cannot be used to distribute
"cracked" versions of copyrighted software (aka warez), serial numbers for
copyrighted software or copyrighted multimedia files (i.e. music files or
MP3's). Sites that contain links to pirated software or illegal contraband
are also prohibited. | |
| d. |
Adult content.
Sites containing adult material, links
to adult material, or adult-oriented merchandise are not permitted. The
final determination of what constitutes "adult content" is made by Central
Host Office. |
| e. |
Security violation.
Attempts to manipulate the servers or
client web sites are prohibited. This includes, but is not limited to,
attempting to gain unauthorized access to servers, mail bombing, or other
means of deliberately overloading systems. Currently, running any form of
PHP-Nuke is also not allowed and will be construed as a security
violation. |

Log files.
Log files will be deleted periodically.
It is recommended that clients who wish to maintain logs covering extended
periods download the log files monthly. |
| 8. |
Hosting fees.
Hosting fees must be paid before
service is activated. Hosting fees are not refundable. |
| 9. |
Domain registration fees.
Domain registration fees are not
included in the webhosting fees charged by Central Host Office. The client
will be billed separately, and is responsible for timely domain registration
payment. Central Host Office has arranged for lower rates for
.com/.net/.org/.biz/.info domain registration, but not
for .ph registration. |
| 10. |
Billing cycle.
All services are billed on an annual
basis. The minimum
contract for any service is one year. A billing cycle change can be made at
any time, provided there are more than 30 days remaining in the current
billing cycle. An expiring host service must be paid prior to end of
service, or will be canceled. Reactivation will be treated as a new
account. |

Cancellation.
Central Host Office reserves the right
to cancel service of an account at any time without notice and without a
refund, in the event that the account violates our posted policy, and/or
payment for hosting fees is not received. An account can be canceled
voluntarily at any time by
email or by sending a fax message
to +63-2-7261013. Web site files for
canceled accounts are removed from the server at least 24 hours after the
cancellation date, and become unretrievable. The same 24 hours allows the
owner to transfer his data and/or reconsider his decision. Fees already paid
will not be refunded. |
| 12. |
This constitutes the entire agreement.
The unenforceability of any portion of
this agreement will not invalidate the rest of this agreement. |
